The following terms and conditions are issued by TeacherTalk Limited. They will apply between you and teachertalk.org.nz when you use this website. By placing an order you are agreeing to accept these terms and conditions.

This website is owned and operated by TeacherTalk Limited. If you wish to discuss anything regarding these terms and conditions, please Contact Us.

TeacherTalk Limited reserves the right to change these terms and conditions at any time and without notice. It is your responsibility to regularly check these terms and conditions for any changes. If you do not agree with the terms and conditions set out below, you should not use this website.

1. General Information

Your contract for purchases made through teachertalk.org.nz is with TeacherTalk Limited and you undertake that all goods ordered by you are for your own personal and classroom use only and not for resale.

You must be 18 years old to use this site. If you are under 18, you may only use this site with the agreement of and under the supervision of a parent or guardian. If you do not qualify, please do not use this site.

You agree that email can be used as a long-distance means of communication.

During the registration process, you must choose a valid email address and password. You are responsible for all actions taken under that email and password and must only purchase from teachertalk.org.nz under your own email and password. It is the responsibility of the customer to keep his or her password confidential and TeacherTalk Limited accepts no responsibility for misuse, or use by a third person, of your password.

If there are any changes to the details supplied by you, it is your responsibility to inform teachertalk.org.nz as soon as possible.

You undertake that all details you provide to TeacherTalk Limited, for the purpose of ordering or purchasing goods or services are correct and accurate, that the credit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.

TeacherTalk Limited reserves the right to terminate our agreement with you and to suspend or terminate your access to the site immediately and without notice to you if:

  • You fail to make payment to us when due.
  • You breach any of our terms and conditions.
  • When requested by us to do so, you fail to provide within a reasonable time frame, enough information to let us check the accuracy and validity of any information supplied by you or your identity.

3. Terms of Sale

By placing an order you are offering to purchase a product on and subject to our terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times, are limited to the North Island and South Island of New Zealand and subject to any delays resulting from postal delays or force majeure, for which we will not be responsible. Please see our Delivery Charges notice for further information.

a. Our Contract
After you place an order, you will receive an acknowledgment email confirming receipt of your order and the total price payable for the order including delivery charges. This email will be an acknowledgment of your order and constitutes acceptance of your order. The goods which you have ordered will have been dispatched to you. Only those goods listed in the confirmation email sent at the time of dispatch will be included in the contract formed.

b. Pricing and Availability
Whilst we try to ensure that all prices, details and descriptions on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered prior to payment being made, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you we will treat the order as canceled. If you cancel and you have already paid for the goods, you will receive a full refund.

All shop prices are displayed inclusive of GST unless otherwise stated. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the total cost.

c. Payment
We accept MasterCard and Visa payments through our website. All payments via our website are processed using eWay, secure host, whereby sensitive credit card information is encrypted.

All transactions are in New Zealand Dollars (NZD $). We have an invoice option as well for orders over $30.

d. Downloads
By placing an order for a download item you are offering to purchase a product on, and subject to our terms and conditions. Downloads are available for one month after purchase and are received via email through invoice or upon receipt of payment. Instructions to download are on the invoice. All orders for downloads must be paid for and it is up to the buyer to complete the download of the product.

4. Delivery Times & Order Tracking

Stock permitting, all orders are dispatched within two working days. Deliveries are only made on working days and not on weekends. Most orders going to a North Island address will be delivered within 24 hours and orders going to a South Island address, within 48 hours after dispatch. Orders received on Saturdays, Sundays and Public Holidays will be processed the following working day.

Once your order has been dispatched you will receive an email that contains a tracking number.

Delivery Method – Courier (Toll Group & NZ Courier)

  • Online orders are delivered using courier so that they can be tracked. 
  • All deliveries are door to door only.
  • Transit times do not include weekends or public holidays.
  • All delivery time frames are estimates only, we cannot be held responsible for delays outside of our control.
  • Please be advised that we do not ship to PO Boxes or Private Bags.

5. Returns & Refunds

We aim to provide a very high standard of customer service and are very confident in the quality of our products. If for any reason you are not satisfied with your order we will aim to resolve any issues you may have. Please refer to our Refunds and Returns Policy Page for more detailed information.

6. Limited Liability

We do not accept liability for any errors and/or omissions contained in our website. We reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice.

The products sold on teachertalk.org.nz are for private and classroom use only. Accordingly, we do not accept liability for any direct loss, consequential loss, loss of data, loss of income or profit, loss or damage to property and/or loss from claims of third parties arising out of the use of the site or for any products or services purchased from teachertalk.org.nz

We have taken every measure to prevent Internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers.

To the fullest extent permitted by law, TeacherTalk Limited nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of TeacherTalk Limited or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.

While we endeavour to supply accurate information on this site, errors and omissions may occur. TeacherTalk Limited does not accept any liability, direct or indirect, for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission whether negligent or otherwise, contained on this site. You are solely responsible for the actions you take in reliance on the content on or accessed through this site.

7. Disclaimer as to ownership of trademarks, images and third party copyright

Except where expressly stated to the contrary, all persons (including their names and images), third party trademarks and images of third party products, services and/or locations featured on this website are in no way associated, linked or affiliated with TeacherTalk Limited and you should not rely on the existence of such a connection or affiliation. Any trademarks/names featured on this website are owned by the respective trademark owners. Where trademark or brand name is referred to, it is used solely to describe or identify the products and services and is in no way an assertion that such products or services are endorsed by or connected to TeacherTalk Limited.

All rights, including copyright, in the content of teachertalk.org.nz web pages, are owned or controlled by TeacherTalk Limited. In accessing teachertalk.org.nz web pages, you agree that you may download the content for your own individual and non-commercial use. 

By downloading TeacherTalk resources you are agreeing to the terms of this user license below:

You may purchase and download the printable PDF document for your personal use at home, or for use as a teacher with your own class, group or centre.

You may not alter, edit or change the documents in any way for the purpose of distribution.

The only prices that apply for TeacherTalk Limited are those stated on the teachertalk.org.nz website. We cannot vouch for the reliability or prices stated on shopping directories or through any other third party.

11. Law

These terms and conditions are to be construed in accordance with the laws of New Zealand and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the New Zealand courts.

12. Entire Agreement

The above Terms and Conditions constitute the entire agreement of the parties and supersedes any and all preceding and contemporaneous agreements between you and TeacherTalk Limited. Any waiver of any provision of the Terms and Conditions will be effective only if in writing and signed by a Director of TeacherTalk Limited.
